All sessions are conducted via Zoom. You'll receive a secure link before your session. Each party joins from their own location. Fran uses breakout rooms to speak with each party privately when needed.
Do both parties have to be in the same Zoom session?
Yes, but Fran uses Zoom's breakout room feature for private conversations with each party — known as a 'caucus,' a standard mediation technique.
Is a mediated settlement agreement legally binding?
Yes. In Texas, a Mediated Settlement Agreement (MSA) is binding and enforceable. Once signed, neither party can revoke it, and it can be filed with the court to become a final court order.
Do I need an attorney for mediation?
You are not required to have an attorney present. However, Fran recommends consulting with an attorney before and after mediation to ensure you understand your rights and the implications of any agreement.
How do I pay for my session?
Payment is due before your session begins. You'll receive a secure payment link after scheduling. Fran accepts major credit cards and electronic payment.
What if we don't reach an agreement?
Mediation is voluntary and confidential. If an agreement is not reached, nothing said during mediation can be used in court. You retain all your legal rights and options.
